Terms of Sale
By placing an order, you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Despatch times may vary according to availability and subject to any delays resulting from transport delays or extraordinary events for which we will not be responsible. Orders will be accepted by Owen Cripps & Co. Pty Ltd. for delivery in Australia only. Payment is to be made in AU currency. Any contract arising from this website is governed by the laws of Australia.
Contract, Payment and Delivery
In order to contract with Owen Cripps & Co. Pty Ltd. you must be either an account holder or possess a valid credit or debit card issued by a bank acceptable to us. Owen Cripps & Co. Pty Ltd. retains the right to refuse any request made by you. If your order is accepted, we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Owen Cripps & Co. Pty Ltd or may in some cases be a third party. Where a contract is made with a third party, Owen Cripps & Co. Pty Ltd. is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to such changes.
(a) Our Contract
When you place an order, you will receive an acknowledgement email confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract formed.
(b) Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price or calculated cost of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
Products may be added to or removed from the website from time to time. While we do not accept liability for any loss arising, every effort will be made to keep the information up to date and accurate.
All prices in the shopping areas are in Australian dollars ($AU) and excludes GST (10% sales tax). Prices may increase or decrease from time to time. Prices shown at the time of purchase are the prices you will pay. If you are not a preferred account holder, you must pay by either Visa, Mastercard, Amex, PayPal, Afterpay. ApplePay or GooglePay. We will not accept cheques or cash on delivery.
(c) Payment
Owen Cripps & Co. Pty Ltd. is associated with our preferred payment gateway provider. Owen Cripps & Co. Pty Ltd. do not collect or store any credit card information. This information is all sent to and processed by our payment gateway provider.
If you pay by credit card, your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a payment against the value of the goods you wish to purchase. Once the goods have been despatched and you have been sent a confirmation the monies paid, this shall be used as consideration for the value of goods you have purchased as stated in the confirmation.
(d) Delivery
Delivery charges will be added to each order and shown as a separate item before you chose to enter your payment details and send the order to be processed.
Should your order incur an additional charge stated on the website or in the confirmation, we will advise you prior to processing your order.
We will not deliver to a Post Office box or any address in which we deem suspicious.
Should you feel that your goods do not arrive in good condition, please feel free to contact us. We are not responsible for loss or damage to goods that are delivered to an incorrect address.
Disclaimer of Liability
Owen Cripps & Co. Pty Ltd. are not liable for any direct, indirect, special, incidental or consequential damages or loss of profit arising out of the use, or the inability to use, the products on this site. This includes but is not limited to the loss of data or loss of profit, even if Owen Cripps & Co. Pty Ltd. was advised of the possibility of such damages.
The material displayed on this website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law, Owen Cripps & Co. Title and Risk
Goods are at our risk until delivered to the address given for your purchase.
Returns and Refunds
If you discover any defect in your product, you may return the item you purchase in new condition for a replacement within 60 days of delivery. When replacements are not available, we may, at our discretion, provide a complete refund. We’ll notify you via email of the status of the replacement or refund once we’ve received and processed the returned item. You can expect a refund in the same form of payment originally used for purchase within 7 business days of our receiving your return.
Freight will be refunded where the product is faulty or arrived damaged.
